Although most incorporated cities such as Sacramento and Elk Grove have their own police departments, the Sacramento County Sheriff’s Office operates all corrections facilities in the county, so it is the best agency to go through to check local inmate records.

There are two correctional facilities in Sacramento County.

The Sacramento County Main Jail: Houses detained and incarcerated individuals arrested by the Sacramento County Sheriff’s Department and the City of Sacramento Police Department, as well as other law enforcement agencies in the county.2

How To Find Records Married or Divorced Individuals in Sacramento County California

Sacramento County public records can help individuals find out if someone is married or divorced.

The county clerk maintains marriage records and can issue certified copies of marriage certificates for a fee.

On the other hand, Sacramento County’s clerk and vital records office maintain divorce records only if the divorce involved deeds and/or liens. Information for these cases can be found through the clerk’s online index.

Obtain Sacramento County Marriage Records From the Vital Records Office of the County Clerk or County Recorder

Sacramento County’s Clerk/Recorder maintains marriage certificates for licenses issued by the county dating back to 1850.6 Despite the millions of records on file, it’s relatively easy to order certified copies of Sacramento County marriage records and check if someone is married.

Note that Sacramento County issues two types of certified copies:

  1. Authorized: can be used as official identification by one of the parties to the marriage and can be issued only to an “authorized person.”
  2. Informational: cannot be used for identification purposes and are marked as such.

Section 103526(c) of the California Health and Safety Code defines an “authorized person” for marriage certificates as one of the following:

  • A registrant – one of the parties to the marriage named in the certificate (or their parent or legal guardian)
  • Someone entitled to receive the authorized certificate as a result of a court order
  • A member of a law enforcement agency or other governmental agency conducting official business
  • A registrant’s child, grandparent, grandchild, sibling, spouse, or domestic partner
  • An attorney representing a registrant or their estate
  • Any court-appointed person or agency acting on the registrant’s or their estate’s behalf7

Requesters who do not fit one of the above descriptions can receive only an informational copy of the marriage certificate.

Confidential Marriage Certificates: Since 1878, California has offered confidential marriage licenses (Michigan is the only other state to do so). These licenses and related certificates are not on the public record.

California counties do not issue informational certificates for confidential marriages. They will issue authorized copies only to registrants of the marriage or by court order.8

1. Then complete the application for either an authorized or informational marriage certificate. Applicants for an authorized certificate must present a valid government-issued photo ID.

2. Pay a fee of $17 per copy by cash or check. If using the Downtown Sacramento office before 3:00 p.m., applicants may also pay by money order, debit card, or credit card (Note: a service fee of $2.50 applies to all in-person card transactions).

3. Allow 20 minutes from payment receipt to receive the marriage certificate.

Ordering Public Marriage Certificates by Fax: Follow steps 1 and 2 for “Ordering Public Marriage Certificates by Mail.” and then supply credit card information on the application (for an additional processing fee of $6). Next, mail a check or money order to:

Retrieve Records of Divorce From the Sacramento County Superior Court of California

In California, records pertaining to family law are public unless sealed by the court system. That means anyone can view information like a divorce certificate.

It’s free to view public divorce records, but if the researcher doesn’t have a records number for the relevant divorce document, they will need to pay a Records Search fee of $15.

Records searches are $15 and standard copies are 50 cents per page. Now put the envelope in the drop box located inside the entrance to the courthouse (address above). Allow seven to 10 business days for the request to be processed and mailed back.

Considerations for Viewing Public Divorce Records: Note that applicants who wish to view a document filed between 1937 and 1974 must first use the Family Court File Request site before visiting the courthouse. It may take as long as three business days for the file to be ready for viewing. Enquirers must know the case number for the record.

Alternatively, applicants may submit a  Request for Copies of Family Law Records by mail or by putting it in the courthouse drop box.

For public divorce records filed prior to 1937, the court recommends contacting the  Center for Sacramento History.

How To Look Up Criminal History Information in Sacramento County California

Sacramento County public records include criminal records and can reveal if someone has a criminal history, the type of charge, dropped charges, pending charges and more.

The Sacramento County Superior Court of California’s website makes it easy to access case information through the  Public Case Access System. This service is now free of charge to the public.

The Public Case Access System provides information about criminal cases from 1989 to the present. It does not provide information about arrests or other cases in other California courts or counties, other state courts, or federal courts. There are two options for searching criminal court cases, by name or by case.

To conduct a name search, website users must enter both a first name and a last name.

For more information on a specific case, searchers can use the Public Case Access System to find out the relevant case number and then request copies of a criminal case record from the court system.

Cost of Copies: 50 cents per page for uncertified copies. $40 per certification of a copy of paper, record, or proceeding on file. $50 per exemplification. $15 for each record search that takes longer than 10 minutes.

How to Pay: Payment can be made by check or money order payable to Sacramento Superior Court. Alternatively, a credit card payment can be made by completing, printing, and mailing the  Credit Card Authorization Form to the courthouse address above.

Check Your Criminal Record Through the California Department of Justice

The California Department of Justice allows users to obtain copies of their own criminal history records to ensure accuracy, whether or not they reside in the state. Third parties conduct a free criminal record check from the Department of Justice, unless for legitimate law enforcement purposes or other authorized applications.

Note that criminal history records are for an individual’s own review and cannot be used for visa or immigration purposes. California residents can follow the process below and the process for non-residents is one section lower.

  1. Request a live fingerprint scan using form  BCIA 8016RR (English) or  BCIA 8016RR Spanish (Spanish).
  2. On the form, check “Record Review” as the “Type of Application.”
  3. Write “Record Review” on the “Reason for Application” line.
  4. Fill out required personal information, including name, driver’s license number, date of birth, height, weight, Social Security number, etc. A mailing address and a phone number where the applicant can be contacted between 8:00 a.m. and 5:00 p.m. must be included.
  5. Take the completed to one of the  authorized Live Scan sites for fingerprinting. These sites include most local police departments, the Sacramento County Sheriff’s office, and other sites open to the public. Fees vary per location.
  6. Print and complete the  Application to Obtain Copy of State Summary Criminal History Record. A  Spanish version of the form is also available.
  7. Mail all the documents, along with a payment for the $25 processing fee in the form of a check or money order made out to the California of Justice to:

How To Look Into Anyone’s Past by Running a Background Check in Sacramento County

There are many reasons why someone would want to conduct a background check on another person — or even themselves. Depending on what the purpose of the background check is, the process for conducting a check in Sacramento County may differ.

Personal Background Checks: Personal background checks can be helpful if someone is looking to learn more about a new neighbor, date, or acquaintance. They may also choose to run a background check on themselves to make sure there’s no surprising information they weren’t aware of.

Typically, these personal checks do not require the subject’s consent. Nor does the requestor need to provide the reason why they’re conducting the check.

The methods to check public records we discuss in this guide can be considered forms of personal background checks. Alternatively, citizens can also use third-party sites that allow for searches in multiple states and counties for a fee.

Professional Background Checks: Typically, professional background checks are conducted by employers or other entities, rather than a curious individual. They may be done to look into the history of a potential new employee, someone applying for a firearms license, applicants for rental properties, volunteers who want to work with the elderly or children, etc.

In Sacramento, professional checks are carried out through the California Department of Justice. Employers may also run a nationwide background check through the FBI.

Thanks to the  Fair Credit Reporting Act (FCRA), subjects of professional background checks must give their consent before a check can be conducted. In addition, there are other government protections for citizens who believe a professional background check may have wrongly been used against them:

Get a Professional Background Check Done in Sacramento County: Sacramento County does not offer professional background checks. Instead, these checks are conducted by the California Department of Justice (DOJ).

The California Department of Justice conducts only fingerprint-based checks, also known as Level 2 background checks.

Here are the steps to take for one of these checks:

  1. The agency requesting the check must provide the applicant with a  Request for Live Scan Service form.
  2. The applicant visits a  Live Scan site (typically a local police department or sheriff’s office). The Live Scan site will forward the fingerprints to the DOJ.
  3. If no match is found, the agency will have a response within 72 hours from the Department of Justice.
  4. If a match is found, a DOJ technician will manually review the applicant’s history before responding. This can take an indefinite amount of time.

How To Determine Who Has Warrants in Sacramento County, California

Judges and magistrates may issue Sacramento County warrants for several reasons. The most common type of warrants for public records search purposes are arrest warrants, bench warrants, and fugitive warrants. Typically, search warrant records are not available to the public.

Although some other jurisdictions across the country can let searchers know if someone has a warrant open, the Sacramento County Sheriff’s Office can provide warrant information only to the subject of the warrant.

How Do I Discover Who Is on Probation in Sacramento County?

In Sacramento County, most probation information is not on public record. If the subject of a probation search is under the age of 18, all of their probation information is private.

That said, interested parties can use the  Public Case Access page for the Sacramento County Superior Court to find out if someone is on probation.

Simply go to the page and search the individual using their first and last names. Clicking on their criminal court records will include information about whether or not they are on probation.

How To Search Court Case Information & Documents in Sacramento County California

Sacramento County’s Superior Court makes searching for court records relatively easy.

Interested parties can locate and retrieve Sacramento County judicial records through either a free public records search online or by requesting a records search through the courthouse.

How To Obtain Vital Records in Sacramento County: Birth & Death Certificates

Sacramento County maintains birth and death certificates for individuals who were born or who have died in the county since 1850. The Sacramento County County Clerk/Recorder makes birth certificates available approximately four weeks after the baby’s birth date.

The office recommends calling 916-874-6334 to make sure that a newborn’s record is available.

Under California state law, the office can issue two types of certified birth certificate copies. Information copies are available to all requesters but cannot be used for identity purposes and authorized copies can establish the identity of the person named on the certificate.

In order to receive an authorized copy, the requester must sign a statement under penalty of perjury that they are one of the following:

  • The registrant (the child named on the certificate)
  • The registrant’s parent or legal guardian
  • A party entitled to the record due to a court order
  • An attorney or licensed adoption agency
  • A member of law enforcement or another government agency on official business
  • The child, grandchild, grandparent, sibling, spouse, or domestic partner of the registrant
  • An attorney representing the registrant or their estate
  • Any person or agency appointed by the court to act on behalf of the registrant or their estate.

Either type of certified copy requires the payment of a $32 fee. This fee can be paid by cash, check, money order or debit or credit card.

An additional service fee of $2.50 per transaction applies to in-person credit or debit transactions. Persons who can verify their homeless status may receive a fee-exempt copy.

Acquire a Certificate of Death in Sacramento County

The process for requesting a certified copy of a Sacramento County death certificate is very similar to the process for requesting a certificate of birth.

As with birth certificates, there are two types of certified copies: authorized and informational.

To receive an authorized copy, the requestor must sign a statement under penalty of perjury that they are:

  • A parent or legal guardian of the deceased
  • A party entitled to receive the certificate thanks to a court order
  • A member of law enforcement or another government agency on official business
  • The child, grandchild, grandparent, sibling, spouse, or domestic partner of the registrant
  • An attorney representing the registrant’s estate
  • Any person or agency appointed by the court to act on behalf of the registrant’s estate.
  • An agent or employee of a funeral establishment acting within the course and scope of their employment

Fees for certificates of death are $24 per copy. An additional service fee of $2.50 per transaction applies to in-person credit or debit transactions.

A requester can obtain the certificate of death by visiting one of the office’s locations (see above), by mail, or by fax. The process for requesting a death certificate by mail or fax is the same as for birth certificates above. However, a separate request form must be used.
